Drainage District No. 2 generally owns no land where the drains are located. Weeds and other cleanup of the banks along the drain are the responsibility of the property owner.
The drainage district is responsible for the ditch from the water line down.
The property owner is responsible for the water line up and out to the full width of the easement, which is 25-ft from the top of the bank, on both sides of the ditch, or a total of 100 ft from center, whichever is greater for open drains. The shape of the drain shall remain unchanged. Garbage, wastes, and debris shall not be put into the drain.
The drainage district does not pipe any of its waterways. Permission must be granted by the drainage district for any piping. The property owner, whether an individual or a developer or whomever “inherits” the pipe is responsible for the pipe and its maintenance, repair or replacement.
