The drainage district’s easements are approved by the courts and the rights have been codified. For Drainage District No. 2, the easement for open drains is 25-ft from top of bank, on both sides of the ditch, or a total of 100 ft from center, whichever is greater. For closed or piped drains, the easement is 25-ft from center or a total of 50-ft encompassing both sides of the drain.
The easement is for the purpose of cleaning, maintaining and repairing of the waterway. The easement is a place for the drainage district to be able to place their spoils. The district is under no obligation to clean up those spoils.
What Can Be In The Easement?
No fences, permanent structures, trees, bushes, gardens, pet enclosures, swing sets, pools, RV’s, etc. (anything that the property owner values) shall be within the granted easement.
These items can and will be removed without warning and may be at risk of damage by equipment working within the easement.
